Louisiana's offshore workers are not covered by ordinary workers' comp — federal maritime law applies instead, and it can mean far more.
Who the Jones Act Protects
The Jones Act protects 'seamen' — workers who spend a significant portion of their time aboard a vessel in navigation. This includes many offshore oil-and-gas workers, crew members, and others on rigs and supply boats throughout the Gulf.
Unlike state workers' comp, the Jones Act lets an injured seaman sue their employer for negligence and recover broader damages.
Maintenance and Cure
Injured seamen are also entitled to 'maintenance and cure' — daily living expenses and medical care — regardless of fault, until they reach maximum medical improvement. Employers who wrongly deny these benefits can face additional penalties.
Other Maritime Laws
Dock and harbor workers who are not seamen may be covered by the Longshore and Harbor Workers' Compensation Act instead. Determining which law applies is complex and critical, so experienced maritime counsel is essential.
